Release 1 . This is the first release of this unit of competency in the TLI Transport and Logistics Training Package.

Application

This unit involves the skills and knowledge required to determine the origin of goods and to interpret the application of preference schemes and/or free trade agreements to those goods.

Work must be carried out in compliance with the relevant customs requirements, and relevant legislation requirements concerning the determination of origin of goods.

Work is undertaken in a range of environments, including small to large worksites, in the customs broking and international supply chain industries.

No licensing, legislative or certification requirements apply to this unit at the time of publication.

Determine eligibility for preferential tariff rates 

1.1 

Place or country of origin of goods presented for clearance are identified in accordance with commercial documents, including certificates of origin

Eligibility for preferential tariff rates is assessed in accordance with commercial documents, relevant legislation and trade agreements

1.3 

Goods presented for clearance are checked to confirm eligibility and/or compliance with Customs Act as amended and/or other legislation and associated rules of origin and preference

1.4 

Certificates and/or declarations of origin are checked for accuracy and compliance with legislation and/or customs policy as required

Compliance with consignment rules is confirmed as required

Apply relevant preference scheme s or free trade agreement 

2.1 

Requirements of relevant preference schemes are identified, interpreted and applied in accordance with relevant legislation

Performance Evidence

Evidence required to demonstrate competence in this unit must be relevant to and satisfy all of the requirements of the elements and performance criteria on at least one occasion and include:

  • applying correct preference scheme and rule or origin
  • assessing evidence of compliance accurately
  • establishing origin code, preference scheme and rule of origin
  • identifying and applying consignment rules
  • identifying the requirements of preference schemes and/or free trade agreements
  • interpreting and applying relevant free trade agreement
  • identifying:
  • eligible goods for preference purposes
  • places and countries where preferential tariff rates may apply.

Knowledge Evidence

Evidence required to demonstrate competence in this unit must be relevant to and satisfy all of the requirements of the elements and performance criteria and include knowledge of:

  • Australia’s current free trade agreements
  • free trade agreements that Australia has under negotiation
  • function of a Certificate of Origin or Declaration of Origin
  • how to determine:
  • duty rates under preferential tariff schemes and free trade agreements
  • consignment rules under preferential tariff schemes and free trade agreements
  • rules of origin under preferential tariff schemes and free trade agreements
  • legislative requirements for determining:
  • eligibility for preferential rates
  • origin of goods
  • mandatory content of a Certificate and/or Declaration of Origin
  • types of preferential tariff schemes including classes of countries and places where special rates apply
  • use of advance ruling
  • benefits and use
  • origin of advance rulings
  • review processes.

Assessment Conditions

Assessors must hold credentials specified within the Standards for Registered Training Organisations current at the time of assessment.

Assessment must satisfy the Principles of Assessment and Rules of Evidence and all regulatory requirements included within the Standards for Registered Training Organisations current at the time of assessment.

Assessment must occur in workplace operational situations where it is appropriate to do so; where this is not appropriate, assessment must occur in simulated workplace operational situations that replicate workplace conditions.

Assessment processes and techniques must be appropriate to the language, literacy and numeracy requirements of the work being performed and the needs of the candidate.

Resources for assessment must include access to:

  • a range of relevant exercises, case studies and/or simulations
  • applicable documentation including workplace procedures, regulations, codes of practice and operation manuals.
