Application

This unit of competency describes the skills and knowledge required to prepare and present own evidence related to observations in court according to courtroom protocols and procedures.

The unit applies to individuals who may be witnesses resulting from their role as observers. They may be required to present their own evidence as a witness in a judicial or quasi-judicial setting.

All work must be carried out to comply with workplace procedures, according to state/territory health and safety, biosecurity and environmental regulations, legislation and standards that apply to the workplace.

No licensing, legislative or certification requirements apply to this unit at the time of publication.

1. Prepare for and attend briefing with prosecutor

1.1 Confirm briefing arrangements prior to briefing with prosecutor

1.2 Confirm own evidence and relevant documentation required at briefing with prosecutor or representative

1.3 Record and document briefing details and complete required actions according to prosecutor instructions

2. Prepare for presentation of own evidence

2.1 Confirm judicial proceedings, protocols, procedures and responsibilities and roles

2.2 Organise supporting evidence in accordance with own statement of evidence according to prosecutor instructions

2.3 Review own evidence to be presented for accuracy and completeness

3. Present own evidence

3.1 Present own evidence in court in a clear and concise manner

3.2 Adhere to judicial protocols and procedures

3.3 Follow prosecutor's instructions throughout proceedings

3.4 Provide advice and opinions as requested

Performance Evidence

An individual demonstrating competency must satisfy all of the elements and performance criteria in this unit.

There must be evidence that the individual has presented own evidence in a court setting on at least one occasion, including:

  • preparing accurate own statement of evidence and documentation according to the prosecutor's requirements
  • presenting own evidence in a clear, concise and logical manner, following courtroom protocols and procedures.

Knowledge Evidence

An individual must be able to demonstrate the knowledge required to perform the tasks outlined in the elements and performance criteria of this unit. This includes knowledge of:

  • agency policies and procedures relating to evidence
  • courtroom procedures and protocols in presenting evidence
  • roles and responsibilities of officers of the court
  • rules of evidence in a legal proceeding.

Assessment Conditions

Assessment of skills must take place under the following conditions:

  • physical conditions:
  • skills must be demonstrated in a courtroom or a mock court setting that accurately represents realistic conditions
  • resources, equipment and materials:
  • sample prosecution brief
  • evidence relevant to the brief
  • specifications:
  • workplace policies and procedures relating to presenting evidence in court
  • relationships:
  • evidence of interactions with legal personnel.

Assessors of this unit must satisfy the requirements for assessors in applicable vocational education and training legislation, frameworks and/or standards.
