Application

This unit of competency specifies the skills and knowledge required to apply building control legislation to assess the accessibility of small-scale buildings. Small-scale buildings are buildings of any Class as defined in the National Construction Code (NCC), but which do not exceed 2,000 square metres in floor area. The unit includes understanding the Australian common law system and the various sources of law applicable to the accessibility of small-scale building developments and identifying and applying the relevant professional code of practice required for the assessment and inspection of buildings.

This unit is for individuals who work independently using specialised knowledge to conduct a range of access consulting services.

No licensing, legislative or certification requirements apply to this unit at the time of publication.

Identify legal requirements relating to small-scale buildings.

Identify legal requirements associated with the provision of access to small-scale buildings from relevant building control and anti-discrimination legislation.

Identify and document legislative benefits and building accessibility enforcement strategies.

Identify processes for addressing regulatory non-compliance issues and prepare related working documentation in a format suitable for review by a building certifier.

Identify and implement professional code of practice.

2.1

Identify and interpret professional code of practice applicable to assessment activities.

2.2

Identify and document duty of care obligations associated with assessment activities to meet common law requirements.

2.3

Identify potential conflicts of interest associated with assessment activities and seek guidance from relevant persons as required.

Implement strategies to develop and maintain effective working relationships with building certifiers.

Apply legal requirements to accessibility assessment of small-scale building.

3.1

Interpret relevant documentation to assess compliance of small-scale building accessibility with relevant legislation.

Consult with relevant persons to discuss accessibility of small-scale building and any identified regulatory non-compliances.

Performance Evidence

To demonstrate competency, a candidate must meet the elements and performance criteria of this unit by applying building control legislation to accessibility assessments for two small-scale buildings in the following Classes as defined by the National Construction Code (NCC):

  • one building in Class 1
  • one building included in Classes 2-9.

Knowledge Evidence

To be competent in this unit, a candidate must demonstrate knowledge of:

  • Australian administrative law system applicable to the accessibility of small-scale buildings
  • building and construction terminology and definitions relevant to accessibility assessments of small-scale buildings
  • Commonwealth, state and territory legislation, regulations, standards and codes relevant to access consulting activities:
  • anti-discrimination and disability discrimination
  • building control including local government regulations and by-laws
  • NCC building classifications and access requirements
  • Disability (Access to Premises – Buildings) Standards 2010 under the Disability Discrimination Act 1992 (or their successors) – known as the Access to Premises Standards
  • National Disability Insurance Scheme (NDIS) Specialist Disability Accommodation Design Standard (or its successor)
  • Livable Housing Australia Livable Housing Design Guidelines (or its successor)
  • principles of universal design
  • privacy and confidentiality
  • industry codes of practice and ethics relevant to access consulting and definitions of:
  • duty of care as it relates to common law
  • conflict of interest
  • legal terminology, definitions, processes and procedures used in standard court operations
  • responsibilities and statutory duties of building certifiers
  • types of disability and limitations that each disability places on an individual’s ability to access the environment
  • workplace requirements for applying building control legislation to accessibility assessments of small-scale buildings:
  • documentation and records administration
  • quality
  • work role boundaries - responsibilities, limitations and professional abilities.

Assessment Conditions

Assessors must meet the requirements for assessors contained in the Standards for Registered Training Organisations.

Assessment must be conducted in the workplace or a simulated workplace using realistic conditions, materials, activities, responsibilities, procedures, safety requirements and environmental considerations.

Candidates must have access to documentation, information and technologies required to achieve the performance criteria and performance evidence.
